THE captain of the Bayesian superyacht has broken his silence after the vessel sank off the coast of Sicily.

One person has died and six remain missing after the £14m yacht was hit by a tornado yesterday at about 5am local time.

The £14m Bayesian superyacht sank off the coast of Sicily, Italy yesterday

The boat sank just a couple hundred metres off the shore 50m below the waves.

Those on board said the  mast collapsed in stormy weather causing glass to shatter everywhere and the boat to capsize.

Witnesses said a 12-minute waterspout had struck the boat, bringing a furious vortex against the vessel.

The ship's captain James Calfield, 51, spoke from hospital yesterday and said he had no idea the tornado was coming towards the ship.

"We didn't see it coming," he told La Repubblica .

Others told Italian outlet Ansa that the anchor was down when the storm hit on Monday morning, causing the ship to lose its balance.

Some 22 horrified passengers, made up of passengers and staff, screamed in fear as the boat flipped over.

The body of one man, the boat's chef, has been found near the destroyed ship.

Fifteen people were rescued from the water, including a one-year-old British girl, whose mum held her above her head before they were saved.

Mike Lynch, previously dubbed "the British Bill Gates", was hosting a party on the boat along with his wife and daughter.

Luca Mercalli, president of the Italian Meteorological Society, said 200kmh winds could be felt over Sunday through Monday.

He described the weather as: “A so-called funnel cloud forms, generating winds of up to 200kmh which can create a water spout at sea by sucking water into the air.

“The event can be restricted to a few hundred metres and be over in ten minutes."

The Bayesian has the highest aluminium mast in the world with experts believing the height could have caused the vessel to tip over.

The yacht slept 22, with 10 being staff

A one-year-old British girl named Sophia was  rescued by her mother  Charoltte Golunski in the sea after the sinking before they were rushed to hospital.

Golunski spoke about the frantic rescue, telling Giornale di Sicilia: "For two seconds I lost the baby in the sea, then I immediately hugged her again amidst the fury of the waves.

"I held her tightly, close to me, while the sea was stormy. Many were screaming.

"I screamed for help but all I could hear around me was the screams of others.

"Luckily the lifeboat inflated and 11 of us managed to get on board."

MOST PASSENGERS FROM UK

The majority of passengers were understood to be from the UK.

Citizens from New Zealand, Myanmar, Sri Lanka, Ireland, Canada, the US and two dual British-French nationals were also on board.

THE BAYESIAN superyacht was hosting a lavish party for 12 guests, with 10 crew also onboard.

After 15 people were rescued from the water on Monday, six people remain missing and one has been found dead.

Italian authorities said the man recovered near the yacht wreckage was the chef working onboard.

Four of the missing are British and two are American.

Mike Lynch, 59, and his daughter Hannah, 18, are among the four Brits lost at sea.

International chairman of bank giant Morgan Stanley, Brit Jonathan Bloomer, 70, is also missing along with his wife Judy.

As is top New York lawyer Chris Morvillo, a solicitor at major firm Clifford Chance who worked for Mike Lynch, and his wife Neda.

World News | Divers recover 5 bodies from wrecked superyacht off Sicily; 1 still missing

Morgan Stanley logo.

PORTICELLO, Sicily (AP) — Divers searching the wreck of a superyacht that sank off Sicily found the bodies of five passengers Wednesday, leaving one still missing as questions intensified about why the vessel sank so quickly when a nearby sailboat remained largely unscathed.

Rescue crews brought four body bags ashore at Porticello. Salvatore Cocina, head of the Sicily civil protection agency, said a fifth body had been located. Divers on-scene said they would try to recover it on Thursday while continuing the search for the sixth.

The discovery made clear the operation to search the hull on the seabed 50 meters (164 feet) underwater had quickly turned into a recovery one, not a rescue, given the amount of time that had passed and with no signs of life over three days of searching.

The Bayesian, a 56-meter (184-foot) British-flagged yacht, went down in a storm early Monday as it was moored about a kilometer (a half-mile) offshore. Civil protection officials said they believed the ship was struck by a tornado over the water, known as a waterspout.

Fifteen people escaped in a lifeboat and were rescued by a nearby sailboat. The body of the ship’s chef, Recaldo Thomas of Antigua, was recovered Monday.

Thomas was born in Canada, according to his cousin David Isaac, but visited his parents’ homeland of Antigua as a child, and moved permanently to the tiny eastern Caribbean island in his early 20s. Italian officials previously listed Antigua and Canada as the nationality of people on board.

The fate of six missing passengers had driven the search effort, including British tech magnate Mike Lynch , his 18-year-old daughter and associates who had successfully defended him in a recent U.S. federal fraud trial.

Lynch’s spokesperson did not respond to a request for comment Wednesday.

Meanwhile, Termini Imerese Public Prosecutor’s Office investigators were acquiring evidence for their criminal investigation, which they opened immediately after the tragedy despite no formal suspects having been publicly identified.

Questions have abounded about what caused the superyacht, built in 2008 by Italian shipyard Perini Navi, to rapidly sink, when the nearby Sir Robert Baden Powell sailboat was largely spared and managed to rescue the survivors.

Giovanni Costantino, head of The Italian Sea Group, which owns the ship maker, blamed human error for the disaster, which he said took 16 minutes. “The ship sank because it took on water. From where, the investigators will say,” he told RAI state television after he met with prosecutors.

Costantino cited AIS ship tracking data which he said showed the Bayesian had taken on water for four minutes when a sudden gust of wind flipped it and it continued taking on water. The ship straightened up slightly and then went down, he said.

But was it merely the case of a freak waterspout that knocked the ship to its side and allowed water to pour in through open hatches? What was the position of the keel, which on a large sailboat like the Bayesian might have been retractable to allow it to enter shallower ports?

“There’s a lot of uncertainty as to whether it had a lifting keel and whether it might have been up,” said Jean-Baptiste Souppez, a fellow of the Royal Institute of Naval Architects and the editor of the Journal of Sailing Technology. “But if it had, then that would reduce the amount of stability that the vessel had, and therefore made it easier for it to roll over on its side,” he said in an interview.

The captain of the sailboat that rescued survivors said his craft sustained minimal damage — the frame of a sun awning broke — even with winds that he estimated reached 12 on the Beaufort wind scale, which is the highest hurricane-strength force on the scale.

He said he had remained anchored with his engines running to try to maintain the ship’s position as the forecast storm rolled in.

“Another possibility is to heave anchor before the storm and to run downwind at open sea,” Karsten Borner said in a text message. But he said that might not have been possible for the Bayesian, given its trademark 75-meter (246-foot) tall mast.

“If there was a stability problem, caused by the extremely tall mast, it would not have been better at open sea,” he said.

Yachts like the Bayesian are required to have watertight, sub-compartments that are specifically designed to prevent a rapid, catastrophic sinking even when some parts fill with water.

The underwater search continued in dangerous and time-consuming conditions. Because of the wreck’s depth, which requires special precautions, divers working in pairs could only spend about 12 minutes at a time searching, though reinforcements outfitted with special equipment to enable longer dives were on the wreck Wednesday.

In all, some 27 divers took rotations, including four who helped with recovery after the 2012 Costa Concordia disaster off Tuscany. They called the Porticello wreck a “little Concordia,” fire crews said in a statement.

The limited dive time was aimed in part at avoiding decompression sickness, also known as the “bends,” which can occur when divers stay underwater for long periods and ascend too quickly, allowing nitrogen gas dissolved in the blood to form bubbles.

“The longer you stay, the slower your ascent has to be,” said Simon Rogerson, the editor of SCUBA magazine. He said the tight turnaround time suggested the operation’s managers were trying to limit the risks and recovery time after each dive.

“It sounds like they’re operating essentially on no decompression or very tight decompression, or they’re being extremely conservative,” he said.

Divers were also working with debris floating around them, limited visibility and air tanks on their backs.

“We are trying to advance in tight spaces, but any single thing slows us down,” said Luca Cari, spokesman for the fire rescue service. “An electric panel could set us back for five hours. These aren’t normal conditions. We’re at the limit of possibility.”

Winfield reported from Rome and Kirka from London. Associated Press journalists Trisha Thomas in Rome; Andrea Rosa in Porticello; and Anika Kentish in St. John’s, Antigua, contributed to this report.

This story has been corrected to reflect that Thomas was born in Canada, not Antigua.

Dnc coverage: kamala harris closes with ‘new way forward’ address; election day sprint begins, news world news, body of british tech magnate mike lynch is among those recovered from yacht wreckage, officials say.

One woman remains missing. She has not been identified, but Hannah Lynch, Lynch’s 18-year-old daughter, is reportedly unaccounted for . The family had been celebrating his recent acquittal on fraud charges with the people who defended him at trial in the United States.

Five others were recovered by rescue crews following Monday’s tragedy.

The Bayesian, a 56-meter (184-foot) British-flagged yacht, went down in a storm early Monday as it was moored about a kilometer (half a mile) offshore. Civil protection officials said they believe the ship was struck by a tornado over the water, known as a waterspout , and sank quickly.

Termini Imerese Public Prosecutor’s Office investigators were collecting evidence for a criminal investigation, which they opened immediately after the tragedy despite no formal suspects having been publicly identified.

The chief executive of The Italian Sea Group, which owns the Bayesian’s manufacturer, told the AP in an interview on Thursday that superyachts like these are “designed to be unsinkable.”

“And it is unsinkable not only because it is designed in this way, but also because it is a sailing ship and sailing ships are the safest ever,” CEO Giovanni Costantino said.

Costantino added that “obviously they must not hit the rocks violently, discarding the hull, and they must not take in water,” suggesting the second possibility was the most likely in this case.

Costantino also noted that sailing ships require “a greater competence” to be guided compared with motor boats.

Investigators are now looking at why the Bayesian, built in 2008 by Italian shipyard Perini Navi, sank while a nearby sailboat remained largely unscathed . Fifteen of the 22 people aboard survived by escaping in a lifeboat, including a mother who reported holding her 1-year-old baby over the waves to save her. They were rescued by the sailboat Sir Robert Baden Powell.

The sailboat’s captain, Karsten Borner, said his craft sustained minimal damage — the frame of a sun awning broke — even with winds that he estimated had reached 12 on the Beaufort wind scale, the highest hurricane-strength force on the scale.

He said he had remained anchored with his engines running to try to maintain the ship’s position as the forecast storm rolled in.

“Another possibility is to heave anchor before the storm and to run downwind at open sea,” Borner said in a text message. But he said that might not have been possible for the Bayesian, given its 75-meter (246-foot) tall mast.

“If there was a stability problem, caused by the extremely tall mast, it would not have been better at open sea,” he said.

Yachts like the Bayesian are required to have watertight compartments that are specifically designed to prevent a rapid, catastrophic sinking even when some parts fill with water.

Lynch is the only person confirmed dead; the other bodies have not been formally identified by the Italian coast guard.

Besides Hannah Lynch, those missing are Christopher Morvillo, one of Lynch’s U.S. lawyers, and his wife, Neda; Jonathan Bloomer, chairman of Morgan Stanley’s London-based investment banking subsidiary, and his wife, Judy.

The body of chef Recaldo Thomas was the first to be recovered , on Monday. His death was confirmed by his family.

Friends of Thomas, best known as “Rick,” paid tribute to him on Thursday at a favorite bar in the Caribbean Island of Antigua. Cooking for Lynch was supposed to be one of Thomas’ last jobs before retiring, his cousin, David Isaac, told the AP.

Divers have struggled to find the bodies in the yacht’s hull on the seabed 50 meters (164 feet) underwater.

“We would need a crystal ball to know when we’ll be able to find the next body,” said Luca Cari, spokesperson for the fire rescue service.

“It’s very difficult to move inside the wreckage. Moving just one meter can take up to 24 hours,” Cari said.

Bayesian yacht search called off overnight as five bodies found - but one remains missing at sea

A search of the Bayesian superyacht has been called off just hours after the bodies of tech mogul Mike Lynch and his 18-year-old daughter Hannah were found inside

The search of the Bayesian superyacht wreckage will not continue into the night

  • 22:32, 21 Aug 2024

The search of the Bayesian superyacht wreckage has been called off overnight after five bodies were found, with two confirmed as tech mogul Mike Lynch and his daughter Hannah.

Salvatore Cocina, head of Sicily’s civil protection agency, told the PA news agency that searches have finished for the day and will resume on Thursday. He confirmed that five bodies have been found, but only four recovered. One person remains missing, Mr Cocina said.

Search teams made the tragic discovery of Mike Lynch and 18-year-old Hannah on Wednesday after finally breaking in to the cabin of the Bayesian, which sank off the coast of Sicily after being hit by a freak tornado on Monday morning.

The Chief of Civil Protection later said the two bodies were that of the father and daughter, before announcing two more corpses had been recovered. The freak incident came as the 59-year-old Brit was enjoying a victory trip to celebrate winning a US fraud trial.

And Hannah had just landed a place to study English at Oxford. Two bodies were brought ashore shortly before 4pm local time yesterday and were later confirmed as the pair. Three further body bags were transported from the wreck site and taken away under blue lights but their identities remain unknown.

It means one yacht guest remains missing. Still unaccounted for are Jonathan Bloomer, his wife Judy and American citizens Chris Morvillo and his jewellery designer wife Neda. The four guests, plus the tycoon and teen daughter, had been missing since Monday, with specialist divers scrambling to access the boat in the hope air pockets in the cabins could keep them breathing.

The £30 million Bayesian went down in just 60 seconds after being hit off the coast of Porticello on Monday morning. It was carrying 10 crew members and 12 passengers. Earlier a doctor treating the hero mum who saved her baby in the horror said she was sleeping on deck with the tot when disaster struck.

Charlotte Emsley, 36, survived the sinking of the superyacht by reportedly holding her baby above the waves. It emerged as inspectors from the UK’s Marine Accident Investigation Branch (MAIB) arrived on scene on Wednesday.

The MAIB is looking into what happened because the yacht Bayesian was flying a British flag. One expert told the Telegraph authorities are investigating whether hatches left open by crew members contributed to the sinking. The wreckage of Bayesian is resting on the seabed 50 metres deep.

Fire crews said they accessed the vessel through natural entrances, without making openings. And the Italian coastguard said remotely-controlled underwater robots were assisting the search. The devices can remain underwater for at least two hours at a time, providing much-needed help to diving teams who can only search the wreck in 12-minute intervals.

Of the 22 passengers and crew on board, 15 – including Mr Lynch's wife, Angela Bacares – were rescued after escaping onto a lifeboat. Survivors are recuperating at a hotel complex in Porticello, where authorities are gathering witness statements.

Ms Bacares has reportedly been joined by the couple's elder daughter who was not on board the yacht. We earlier revealed the mum-of-two was in a "state of shock and sadness" as she anxiously waited for news. She has reportedly been joined by the couple's elder daughter who was not on board the yacht.

The ship's captain was yesterday confirmed as “well respected” seafarer James Cutfield, 51. The New-Zealander earlier said crew members “didn’t see [the storm] coming.” He is recovering in hospital with his wife by his side.

More of the vessel's rescued crew members were named by the Italian Coastguard on Tuesday, with Leo Eppel and South African nationals Leah Randall and Katja Chicken all confirmed as having been on board. A body recovered at the scene of the sinking on Monday was that of Canadian-Antiguan national Recaldo Thomas, who was working on the superyacht.

Gareth Williams, a friend of the chef, told the BBC : "I can talk for everyone that knew him when I say he was a well-loved, kind human being with a calm spirit." Another pal, Eli Fuller, added Mr Thomas was "friends with everybody,” and was "always positive" and "sought-after" in his profession.

Mr Lynch – once dubbed "Britain’s Bill Gates"– formed his first firm in 1996 with a £2,000 loan, and it morphed into software giant Autonomy. Just months ago, the head honcho - worth around £500 million - was cleared of fraud in the US over the 2011 sale of that firm to Hewlett-Packard.

Earlier Latymer Upper School in Hammersmith, west London, where Hannah Lynch was a pupil, said its "thoughts are with their family and everyone involved." In a separate tragedy, Stephen Chamberlain – the former vice president of finance at Autonomy and Mr Lynch's co-defendant – died after being hit by a car while out jogging in Cambridgeshire on Saturday.

Body of British tech magnate Mike Lynch is recovered from wreckage of superyacht: Coast guard Back to video

One woman remains missing. She has not been identified, but Hannah Lynch, Lynch’s 18-year-old daughter, is reportedly unaccounted for. The family had been celebrating his recent acquittal on fraud charges with the people who defended him at trial in the United States.

Five others were recovered by rescue crews following Monday’s tragedy.

The Bayesian, a 56-metre (184-foot) British-flagged yacht, went down in a storm early Monday as it was moored about a kilometre offshore. Civil protection officials said they believe the ship was struck by a tornado over the water, known as a waterspout, and sank quickly.

Investigators are now looking at why the Bayesian, built in 2008 by Italian shipyard Perini Navi, sank while a nearby sailboat remained largely unscathed.

But he said that might not have been possible for the Bayesian, given its 75-metre (246-foot) tall mast.

The body of chef Recaldo Thomas was the first to be recovered, on Monday. His death was confirmed by his family.

Friends of Thomas, best known as “Rick,” paid tribute to him on Thursday at a favourite bar in the Caribbean Island of Antigua. Cooking for Lynch was supposed to be one of Thomas’ last jobs before retiring, his cousin, David Isaac, told the AP.

Divers have struggled to find the bodies in the yacht’s hull on the seabed 50 metres (164 feet) underwater.

“We would need a crystal ball to know when we’ll be able to find the next body,” said Luca Cari, spokesperson for the fire rescue service.

“It’s very difficult to move inside the wreckage. Moving just one metre can take up to 24 hours,” Cari said.

Divers searching sunken yacht for UK tycoon’s daughter find body

The body of UK tech tycoon Mike Lynch was recovered Thursday from his sunken yacht off Sicily, as the search continued for the last of the six people missing -- his teenage daughter.

Specialist divers were still looking for a missing woman, a coastguard official told AFP, with a source close to the investigation having earlier indicated Lynch's 18-year-old daughter Hannah had yet to be found.

On Wednesday they pulled up four bodies from the wreck of the "Bayesian", while another was brought onland in Porticello, on the north shore of the Italian island near Palermo, Thursday morning.

The latest grim discovery brings the death toll to six, after the body of a man believed to be the yacht's chef was found shortly after the ship went down in a storm before dawn on Monday.

The 56-metre (185 feet) British-flagged sailing boat had been anchored some 700 metres off Porticello when it was struck by a waterspout -- akin to a mini-tornado.

It sank within minutes.

Fifteen people were rescued, including Lynch's wife, but the businessman and his daughter were among six people reported missing.

- 'Unimaginable grief' -

The passengers were guests of 59-year-old Lynch -- a celebrated technology entrepreneur and investor sometimes referred to as the UK's answer to Bill Gates -- celebrating his recent acquittal in a massive US fraud case.

Lynch's lawyer Christopher Morvillo and his wife Neda, and Jonathan Bloomer, the chair of Morgan Stanley International, and his wife Judy, were also among the missing.

"This is an unimaginable grief to shoulder," the Bloomer family said in a statement Thursday.

Jonathan and Judy "were incredible people and an inspiration to many, but first and foremost they were focused on and loved their family and spending time with their new grandchildren", it said.

"Together for five decades, our only comfort is that they are still together now."

Emergency workers brought a hyperbaric chamber to the quayside Thursday, and could be seen performing a test run.

The chambers are used to treat or prevent decompression sickness in divers, commonly known as the bends.

"I would think the hyperbaric chamber has been brought in as a precaution" as the divers searching the yacht are descending to a great depth, Matthew Schanck from the Maritime Search and Rescue Council, told AFP.

- 'Errors' -

Many questions remain about why the yacht sank, and on Thursday the head of the company which built the boat said the tragedy could have been avoided.

"Everything that was done reveals a very long summation of errors," said Giovanni Costantino, head of the Italian Sea Group, which includes the Perini Navi company that built "Bayesian" in 2008.

He told Italy's Corriere della Sera newspaper that bad weather was forecast and all the passengers should have been gathered at a pre-arranged assembly point, with all the doors and hatches closed.

Security camera footage of the ship from the shore showed the lights on its mast going out, which Costantino said indicated a short circuit, meaning that the ship had already taken on water.

"A Perini ship resisted Hurricane Katrina, a category 5 (hurricane). Does it seem to you that it can't resist a tornado from here?" he told the newspaper.

- 'Trapped like mice' -

Costantino said it was "good practice when the ship is at anchor to have a guard on the bridge, and if there was one he could not have failed to see the storm coming".

"Instead it took on water with the guests still in the cabin. They ended up in a trap, those poor people ended up like mice in a trap," he said.

The "Bayesian"  boasted a 75-metre mast, the tallest aluminium sailing mast in the world, according to the Charter World website.

It was reportedly owned by Lynch's family.

Lynch was acquitted on all charges in a San Francisco court in June after he was accused of an $11 billion fraud linked to the sale of his software firm Autonomy to Hewlett-Packard.

A co-defendant, former Autonomy executive Stephen Chamberlain, died after being hit by a car on Saturday in England.

Italian authorities have opened a probe into the sinking, while the UK's marine accident investigation branch sent four inspectors to Palermo.

AN attorney missing with his wife following the sinking of the Bayesian superyacht gushed about his excitement for the future just days before embarking on the doomed voyage, a friend says.

Christopher Morvillo and his wife, Neda , are among six people missing from the luxury $18million yacht which sank in a storm off the coast of Sicily on Monday.

Christopher Morvillo and his wife Neda (seen in 2018) are among the six still missing from the Bayesian wreck

The boat had been chartered by British billionaire tech tycoon Mike Lynch to celebrate his acquittal from a high-profile, years-long criminal fraud trial in Silicon Valley – a landmark victory Morvillo helped him secure.

The British-flagged vessel had been carrying 12 passengers and 10 members of crew when it was engulfed in a fearsome storm at around 4:30am local time on Monday.

Lynch, 59, and his 18-year-old daughter Hannah are among the missing, as is Johnathan Bloomer, the chairman of Morgan Stanley International, and Bloomer's wife Judy.

Morvillo, a partner at the major NYC firm Clifford Chance , appeared on a podcast just days before setting sail on the Bayesian, reflecting on his career-defining legal victory on behalf of Lynch and sharing his plans for the future.

Costa Concordia salvage expert reveals ‘critical 24hrs’ for superyacht victims

Host of the show, David Markus, told The U.S. Sun that Morvillo confessed Lynch's "all-encompassing" legal fight had taken a sizeable toll on him and he was planning to take a significant vacation from work to spend much-needed quality time with his family.

Morvillo shared that he was "excited" about his trip aboard the Bayesian, Markus said.

"He told me that he was going to take a lot of time off, time that he needed. He needed it. His family needed it," said Markus.

"He lives in New York but this case was tried in California, so he was away from his family for a long time, and this was a chance for him to re-energize and spend some time with his family, and celebrate a career-defining moment he'd fought so hard for.

"So he was really excited about that [...] and then to hear that this has happened, it's just sort of mind-numbing.

"I can't believe it. It's just so sad. It's unbelievably sad."

Morvillo's interview with Markus for his podcast, For The Defence , first aired on August 13 and was recorded the week before.

Markus hadn't met Morvillo before recording the episode but they became "fast friends", bonding over their shared profession and love of family, he said.

Morvillo has two adult daughters with his wife Neda: Sabrina, 27, and Sophia, 23.

Markus said the two girls were due to fly out to meet their parents to join them in celebrating Lynch's acquittal.

"I am so relieved the girls hadn't arrived yet when this tragedy struck," Markus said.

"I can't even imagine what those girls must be going through right now.

"I know the entire legal community, myself included, is thinking of them, and our hearts and prayers go out to these two wonderful women who Chris couldn't stop talking about.

"He was so proud of his daughters."

CHILLING REMARKS

In the days before the Bayesian set sail, Markus had been emailing Morvillo about the episode and sharing the positive feedback he'd been receiving.

Morvillo told Markus he was looking forward to reading the reviews once he was aboard the Bayesian and the two men made tentative plans to meet up again once Morvillo was back stateside.

"He was just an amazing person; he was charming, smart, full of life, and just excited to take some time off after all this," said Markus.

"He was also a family guy and a hard worker, and he seemed to have it all.

"I had just gotten to know him, and we had spoken about getting together in person when he got back from the trip.

"This is just an enormous loss, and I feel so heavily for his close friends and family. It's difficult to put into words."

A LinkedIn post authored by Morvillo at the close of Lynch's trial has been drawing attention online for its now-eerie seeming contents in the wake of Monday's tragedy.

In the post, Morvillo thanked his legal team for their "painstaking work" and made a special mention to his family for their enduring support.

The post concludes, "[F]inally, a huge thank you to my patient and incredible wife, Neda Morvillo, and my two strong, brilliant, and beautiful daughters, Sabrina Morvillo and Sophia Morvillo.

"None of this would have been possible without your love and support. I am so glad to be home."

Marvillo signed off the post with the words, "And they all lived happily ever after...."

Chris Morvillo is a partner of the esteemed New York City law firm Clifford Chance

Two months later, he and his wife are missing at sea.

Markus said the post makes for a difficult read now.

"It's so upsetting because people don't realize what a criminal case does. It's all-consuming. It takes everything away from the client and impacts everyone involved, even when you win – it has a great effect," Markus said.

"I know that Mr. Lynch was looking forward to trying to make reforms in the criminal justice arena, and I know he and Chris had spoken about that, and they were looking forward to it.

"So those comments on LinkedIn really strike a chord now."

Markus added that Morvillo's disappearance and suspected death have taught him two key lessons that he'll take in his stride from now on.

"One is how important it is to savor these experiences when they come along," he shared.

"And two is how important family is, which is something Chris understood.

"That's why my heart goes out to his two daughters because he was just so excited to be with them and spend time with them.

"This is just all so shocking and upsetting."

RACE AGAINST TIME

The frantic hunt to find the six missing passengers aboard the Bayesian entered its second day on Tuesday.

The 185ft vessel capsized in the early hours of Monday after it was caught in a tornado off the coast of Porticello, Sicily.

Horrifying surveillance footage captured the vessel being slowly consumed by a downpouring of rain moments before disaster struck.

Of the 22 people on board, fifteen have been rescued, including Lynch's wife Angela Bacares , 57, and a one-year-old girl whose mom held her above her head before they were both saved.

Only one person has been confirmed dead so far: Recaldo Thomas, a Canadian-Antiguan who was the boat's chef.

A shell-shocked Bacares told Italian outlet  La Repubblica  that she and Lynch woke up at around 4am on Monday after the superyacht pitched suddenly.

Screams of terror then shrieked out when the mast collapsed the vessel capsized.

Bacares, who is now wheelchair-bound after walking through broken glass to escape to safety, told local media that "everything was falling" around her and she was almost "carried away" before she managed to escape to safety.

She and her husband weren't concerned at first but as she got up to investigate, the sound of shattering glass sparked panic.

sun one yacht

Divers returned to the site of the wreckage early Tuesday in an attempt to reach the ship's hull some 164ft underwater, where officials believe others may be trapped.

Progress in the rescue mission has been slow because divers can only swim at the depths where the Bayesian is for up to 12 minutes at a time, officials said.

Further hampering efforts is the fact furniture inside the boat has been blocking access to the cabins.

Rescuers have now opened a hole in the Bayesian's hole to aid access.

They are also using an underwater vehicle to help divers, as well as five patrol boats and one helicopter searching from above the water.

Vincenzo Zagarola, a spokesman for the coast guard, said they believe the missing people are still inside as the yacht sank in just a few minutes.

He said: “We think they are still inside the boat, that is our very hard idea. Our search and rescue activity by sea and air has gone on for around 36 hours.

“Of course, we do not exclude that they are not inside the boat, but we know the boat sank quickly.

“We suppose that the six people missing may not have had time to get out of the boat.”

Footage and pictures from the scene showed hordes of firefighters, divers and police scouring the water throughout Monday, overnight and again on Tuesday.

Officials say the vessel is lying "practically intact" on its side at the bottom of the sea, but a "world of objects" including furniture and other debris is causing a series of issues.

Diver Marco Tilotta told reporters at noon local time on Tuesday that rescuers had finished their first dive of the day and would go back down to try and "penetrate inside the vessel".

He said of those feared dead: "We will do everything we can to recover the bodies.

"The weather conditions are worsening but we hope to continue the operations without problems".

'BRITISH BILL GATES' ACQUITTED

Four of the missing from the Bayesian yacht disaster are British and two are American.

Mike Lynch, dubbed "Britain's Bill Gates", and his teenage daughter Hannah are among the missing Brits.

Lynch invited 12 guests aboard the Bayesian to celebrate his triumphant acquittal from a 13-year-long fraud case, stemming from the $11bn sale of his firm Autonomy in 2011.

Passenger Ayla Ronald took the last image on board the doomed boat

Prosecutors accused Lynch and his financial director Shushovan Hussain of using  “every accounting trick in the book” to overinflate the value of his business  by $5bn.

Lynch had been living under house arrest in San Fransisco for more than a year before he was acquitted by a jury just two months ago.

He was facing up to 25 years in prison and was given just a 0.5 percent chance of winning the case, which is the largest of its kind in Silicon Valley's history.

Lynch's colleague and co-defendant in the case, Stephen Chamberlain , died days before the Bayesian's sinking after being struck by a car while jogging near his home in the UK.

Tributes have begun to flood in for Lynch and his daughter.

Hannah's former school, West London's Latymer Upper School, released a statement voicing their shock at the news of the tragedy.

"We are all incredibly shocked by the news that Hannah and her father are among those missing in this tragic incident and our thoughts are with their family and everyone involved as we await further updates," a spokesperson said.

'SHOCK' OVER MISSING ATTORNEY

International chairman of bank giant Morgan Stanley, Brit Jonathan Bloomer, 70, is also missing along with his wife Judy.

Morvillo is a partner at the esteemed Clifford Chance law firm in NYC.

One of his colleagues, Ayla Ronald, was also on board with her husband but both survived.

A spokesperson for the firm told The U.S. Sun they are all "in shock and deeply saddened" by the tragedy.

"Our thoughts are with our Partner, Christopher Morvillo, and his wife Neda who are among the missing, and with their families," said the spokesperson.

"Our utmost priority is providing support to the family as well as our colleague Ayla Ronald, who together with her partner, thankfully survived the incident.

"Our thoughts extend to the other passengers and crew and all those affected. We have no further comment at this time. We, and the families, ask that their request for privacy is honored during this period."

Christopher Morvillo (L) is pictured with fellow Clifford Chance partners Edward C. O’Callaghan, and David B. Raskin, in 2011

According to his bio on the Clifford Chance website, Morvillo has extensive experience representing corporate and individual clients in white-collar government investigations.

From 1999 to 2005, Morvillo served as an assistant US attorney for the Southern District of New York.

Morvillo assisted in the criminal investigation surrounding the September 11, 2001 terrorist attacks on the  World Trade Center  and the Pentagon.

He was also one of the lead prosecutors on the successful 10-month counter-terrorism trial of defense attorney Lynne Stewart and her co-conspirators, one of the longest criminal trials in Southern District history.

The lawyer investigated, tried and handled appeals in a wide variety of criminal cases, including in the area of healthcare fraud, insurance fraud, money laundering, obstruction of justice, and narcotics.

He also deals with related regulatory and civil proceedings, and internal investigations.

His wife Neda runs her own high-end jewelry line using her maiden name Neda Nassiri.

Who is Mike Lynch?

sun one yacht

By Georgie English, Foreign News Reporter

ENTREPRENEUR Mike Lynch is still believed to be missing hours after a £14m luxury yacht capsized in a tornado off the coast of Sicily.

The tech tycoon, dubbed "Britain's Bill Gates", was one of the 22 people sailing onboard the £166,000 a week vessel, the Telegraph reported this afternoon.

Lynch, 59, sold Autonomy Corporation - a tech company for $11b to Hewlett-Packard in 2011.

He has also been involved in Invoke Capital and cybersecurity company Darktrace.

He was awarded an OBE for his services to enterprise in 2006.

Born in Ilford, Lynch had a firefighter father from County Cork and a nurse mother from County Tipperary.

Away from work, Mike is married to wife Angela Bacares and the pair have two children together.

In 2023, the Sunday Times rich list set the couple's value at £852m.

Just weeks ago, Lynch was acquitted of criminal charges by a jury in San Francisco after a 12-year legal battle over the $11bn sale of his firm, Autonomy, to Hewlett-Packard in 2011.

He was extradited to the US on fraud charges back in 2023 with a judge setting his bail at £79m.

US Marshsals took Lynch into custody at Heathrow, putting him in chains and bundling him on board a United Airlines flight.

However, he had a few things in his favour.

The nature of the case led to a boring and turgid trial, including painstaking parades of emails, reports and spreadsheets filled with jargon, leaving jurors glassy-eyed.

One was even dismissed because he repeatedly fell asleep.

Lynch argued that any questionable activity was entirely immaterial in the context of a thriving business bringing in hundreds of millions a year.

While his lawyers claimed the books were approved by outside accountants and that, by British standards, the deals in question were appropriately accounted for.

Lynch was used as the final witness and rather than going "right for the jugular", as his head lawyer Brian Heberlig said, the prosecutors simply "reviewed a chronology of documents, with no probing questions". The jury agreed.

Tech tycoon Mike Lynch, finance executive Jonathan Bloomer among victims found dead on sunken yacht

British tech tycoon Mike Lynch and Morgan Stanley International chair Jonathan Bloomer were among the victims found dead on a luxury yacht that sank off the coast of Sicily on Monday.

Lynch’s death was confirmed by people with direct knowledge of the matter who asked not to be identified. Bloomer and his wife Judy were among the dead, their children said in a statement Thursday.

They were among the five who have been recovered from inside the sunken ship. One person remains missing after the Bayesian was hit by a tornado near Porticello, Sicily, on Monday. Adding to the complexity of the search mission is the “narrowness of the spaces” inside the sunken yacht and “the presence of many objects,” the coast guard said.

Overall, of the 22 passengers in the boat, 15 were rescued Monday. The body of Recaldo Thomas, the ship’s chef, was found soon after the Bayesian sank.

Lynch’s daughter Hannah, Clifford Chance partner Chris Morvillo and his wife Neda have not been officially accounted for.

Italian authorities are investigating exactly how the Bayesian sank – and why it sank so quickly – in a storm that struck in the early hours of Monday morning. The captain and other survivors have been questioned by the local prosecutor’s office, according to Italian media.

The U.K.’s Marine Accident Investigation Branch said it’s also probing the incident, with questions centered on the expansiveness of the yacht’s mast and the state of the hull.

“Right now, there is no evidence that the mast has been snapped,” coast guard spokesman Vincenzo Zagarola told Bloomberg News. “We can also say that, so far, there is no evidence that the hull has been broken. But we don’t have a clear idea yet of the full damage.”

The head of the company that built the Bayesian said the luxury yacht should have been “unsinkable” given sailboats are built in a way that allows for significant listing without capsizing.

“That ship is unsinkable because it is a sailboat,” Italian Sea Group Chief Executive Officer Giovanni Costantino said in an interview with Bloomberg News. His company bought Perini Navi, the Italian shipbuilder that made the Bayesian, in 2022.

Crews aided by military ships, remote-controlled underwater vehicles and helicopters have been searching for missing passengers since Monday. Six guests, including Lynch’s wife Angela Bacares, and nine crew have been rescued.

Lynch, 59, and his family were celebrating his recent acquittal from fraud charges with a small group of advisers when the violent storm struck. The charges stemmed from Lynch’s sale of his software firm Autonomy Corp. to Hewlett Packard Co. in 2011. The Silicon Valley giant went on to accuse Lynch of accounting failures. He’d spent years working to clear his name in court and restore his reputation as one of Europe’s most successful entrepreneurs .

A little more than two months before the yacht accident, a San Francisco jury found Lynch not guilty of criminal charges that he duped HP into overpaying for his company. He was still fighting HP in a civil case in London, where a British judge held him responsible for creating the illusion of a company much larger and more successful than it was.

Rescue workers have had difficulties gaining access to the yacht some 50 meters, about 160 feet, below the surface, citing the depth and position of the vessel’s hull.

“The search will go on as long as necessary,” Zagarola said. “For sure, the whole hull will need to be inspected meter by meter.”

Body of British tech magnate Mike Lynch among those recovered from yacht wreckage

Italian Firefighters scuba divers bring ashore in a green bag the body of one of the victims of the UK flag vessel Bayesian, Wednesday, Aug. 21, 2024. PORTICELLO, Sicily — The Italian coast guard said Thursday the body of British tech magnate Mike Lynch is among those recovered off the coast of Sicily from the wreckage of a superyacht whose builders had called unsinkable.

The Bayesian, a 56-meter (184-foot) British-flagged yacht, went down in a storm early Monday as it was moored about a kilometer (half a mile) offshore. Civil protection officials said they believe the ship was struck by a tornado over the water, known as a waterspout, and sank quickly.

Termini Imerese Public Prosecutor’s Office investigators were collecting evidence for a criminal investigation, which they opened immediately after the tragedy despite no formal suspects having been publicly identified.

The chief executive of The Italian Sea Group, which owns the Bayesian’s manufacturer, said superyachts like these are “the safest in the most absolute sense.”

“First of all, because they have very little surface compared to a yacht facing into the wind,” CEO Giovanni Costantino told Sky News on Wednesday. “Second, with the structure, the drift keel, they become unsinkable bodies.”

Investigators are now looking at why the Bayesian, built in 2008 by Italian shipyard Perini Navi, sank while a nearby sailboat remained largely unscathed. Fifteen of the 22 people aboard survived by escaping in a lifeboat, including a mother who reported holding her 1-year-old baby over the waves to save her. They were rescued by the sailboat Sir Robert Baden Powell.

The sailboat’s captain, Karsten Borner, said his craft sustained minimal damage — the frame of a sun awning broke — even with winds that he estimated had reached 12 on the Beaufort wind scale, which is the highest hurricane-strength force on the scale.

Besides Hannah Lynch, those missing are Christopher Morvillo, one of Lynch’s U.S. lawyers, and his wife, Neda; Jonathan Bloomer, chairman of Morgan Stanley’s London-based investment banking subsidiary, and his wife, Judy; and Recaldo Thomas, the superyacht’s chef.

Sicily yacht capsize: kiwis on board luxury boat that sank.

This handout frame grab taken and released from a video footage provided by Italian Coastguard, shows a Coast Guard boat with Italian fireboats and an Italian fire brigade helicopter search for six others missing after recovering a victim due to a sailboat sank off the coast of Porticello, nosthwestern of Sicily Island, on August 19, 2024. One person was killed and rescuers were searching for six others missing after a luxury superyacht called "The Bayesian" with 22 people aboard majority of those were British, sank during a sudden storm off the coast of Italy's Sicily, officials said, on August 19, 2024. Two New Zealanders were on board a luxury yacht that has sunk off the Sicilian capital Palermo in Italy, the Ministry of Foreign Affairs and Trade says.

One person died and six people are missing.

Ayla Ronald, a New Zealander working in London as a lawyer survived the capsizing, her father Lin Ronald has confirmed.

MFAT has also confirmed a second New Zealander was on board.

However, a spokesperson said there was no reason to believe the New Zealanders are among the missing.

The embassy in Rome was providing consular assistance.

The missing include UK tech entrepreneur Mike Lynch and his daughter.

Lin Ronald told RNZ his daughter was alive and well, but shaken.

His daughter has been working in London at one of the UK's top law firms, Clifford Chance.

He confirmed Wall Street Journal reports she had worked on Lynch's long-running fraud case in the US over the sale of his company to Hewlett Packard.

The yacht trip was to celebrate Lynch's legal win in the wake of serious charges, including fraud.

Regarding the yacht sinking, Lin Ronald said it was "a very unusual very rapid incident which is very sad for all involved".

The luxury yacht was struck by an unexpectedly violent storm and sank off Sicily early on Monday (local time).

The British-flagged Bayesian , a 56-metre-long sailboat, was carrying 22 people and was anchored just off shore near the port of Porticello when it was hit by ferocious weather, the Italian coast guard said in a statement.

Eyewitnesses said the yacht vanished quickly beneath the waves shortly before dawn. Fifteen people escaped before it went down, including Lynch's wife, Angela Bacares, who owned the boat, and a one-year-old girl.

The names of the dead and missing were not immediately released, but a person familiar with the rescue operation confirmed that Lynch and his 18-year-old daughter, Hannah, were not accounted for.

Salvatore Cocina, head of the Civil Protection in Sicily said Jonathan Bloomer, chairman of Morgan Stanley International and Chris Morvillo, a lawyer at Clifford Chance were also among the missing people.

Italian media said the dead man was the yacht's onboard chef.

The Italian coast guard said the missing had British, American and Canadian nationalities. Survivors said the trip had been organised by Lynch for his work colleagues.

"The wind was very strong. Bad weather was expected, but not of this magnitude," a coast guard official in the Sicilian capital Palermo told Reuters.

The captain of a nearby boat told Reuters that when the winds surged, he had turned on the engine to keep control of his vessel and avoid a collision with the Bayesian , which had been anchored alongside him.

"We managed to keep the ship in position and after the storm was over, we noticed that the ship behind us was gone," Karsten Borner told journalists. The other boat "went flat on the water, and then down," he added.

He said his crew then found some of the survivors on a life raft - including a baby girl and her mother - and took them on board before the coast guard picked them up.

Divers inspect wreck

The coast guard said divers were inspecting the wreck of the Bayesian , which was lying at a depth of 49 metres.

Prosecutors in the nearby town of Termini Imerese have opened an investigation to look into what had gone wrong.

Storms and heavy rainfall have swept down Italy in recent days after weeks of scorching heat, which had lifted the temperature of the Mediterranean sea to record levels, raising the risk of extreme weather conditions, experts said.

"The sea surface temperature around Sicily was around 30 degrees Celsius (86 Fahrenheit), which is almost 3 degrees more than normal. This creates an enormous source of energy that contributes to these storms," said meteorologist Luca Mercalli.

"We can't say that this is all due to global warming but we can say that it has an amplifying effect," he told Reuters.

The Bayesian was built by Italian shipbuilder Perini in 2008 and was last refitted in 2020. Its 75-metre mast is the tallest aluminium mast in the world, Perini said on its website.

The shipspotting.com website said the boat was owned by a firm called Revtom Limited. Lynch's wife Bacares is named as the sole shareholder of the firm on company documents.

The yacht's name would resonate with Lynch because his PhD thesis and the software that made his fortune was based on Bayesian theory.

The ship won a string of awards for its design and can accommodate up to 12 guests in six suites and a crew of 10, according to online specialist yacht sites.

The boat left the Sicilian port of Milazzo on 14 August and was last tracked east of Palermo on Sunday evening, with a navigation status of "at anchor", according to vessel tracking app Vesselfinder.

Lynch defeated US fraud charges

Lynch spent more than a decade building Britain's biggest software company and then almost as long again fighting fraud charges related to its multi-billion pound sale.

Lynch founded Autonomy from his ground-breaking research at Cambridge University in 1996, and was lauded by shareholders, scientists and politicians when he sold it to Hewlett-Packard for $US11 billion ($NZ18b) 15 years later.

But in late 2012, HP stunned Wall Street and the City of London by alleging a massive accounting scandal at the business, and writing off $8.8b of its value.

Lynch, known for an abrasive intellectual charm, said HP did not know what it was doing with Autonomy, which searched and organised data using patented algorithms based on a mathematics developed in the 18th century by Reverend Thomas Bayes.

He spent the next 12 years in courts trying to clear his name, locked in some of the biggest legal battles in corporate history.

HP pursued Lynch in London's High Court for $5b. It won most of its case in 2022 and is still awaiting the award of damages.

The judge found that Lynch and another colleague had fraudulently concealed a "fire sale" of hardware and engaged in convoluted reselling schemes to mask a shortfall in sales of Autonomy's software, the business HP coveted.

US authorities filed criminal charges including wire fraud and conspiracy against Lynch and sought his extradition.

The British government came under pressure from Lynch's supporters to block the application. If found guilty, Lynch could have faced decades in jail.

But the appeals failed, and Lynch took the stand in San Francisco in his own defence, where he denied wrongdoing and told jurors that HP had botched the integration of Autonomy.

He was acquitted on all charges and freed after a year under house arrest. Lynch said he was "elated".

"I am looking forward to returning to the UK and getting back to what I love most: my family and innovating in my field," he said.

A person familiar with the rescue effort said Lynch and his wife, Angela Bacares, were on the 56-metre long British-registered Bayesian sailboat when it was struck by an unexpectedly violent storm and sank off the Sicilian capital Palermo early on Monday.

The yacht was owned by Lynch's family and had 22 people on board when it sank just before sunrise.

Lynch was born in 1965 and was raised in Chelmsford near London where his mother was a nurse and his father a fireman. He said his parents instilled in him an appreciation of the value of education.

At Cambridge University, he studied physics, mathematics and biochemistry, and went on to research signal processing for his doctorate. His thesis is still one of the most widely consulted in the university's library, reports have said.

In 1996, Lynch founded Autonomy which searched and organised complex data such as emails, phones calls and video.

Lynch, who has a herd of rare breed cattle on his estate in Suffolk, East England, used some of the proceeds of the sale of Autonomy to set up venture capital firm Invoke.

It was a major backer of Darktrace, a British cyber security company that US firm Thoma Bravo agreed to buy for $5.32 billion in cash in April.
