Although the driver was arrested for reckless and imprudent driving, no charges were brought against him. "We are very fortunate that none of the passengers were thrown out of the vessel. Especially since falls overboard are the most common fatality accident on a boat. Slow down and allow yourself plenty of time to reach your destination whether in a vehicle or by boat. You need to be ready to expect higher numbers of traffic on the water and road," Sgt.Jerry Callahan said in a statement, according to local news station KRCG-TV. The bizarre boating accident occurred Friday, Aug. 24 at Missouri's Lake of the Ozarks when six passengers and one driver, identified as Marvin Carter, took the "Fountain" power boat to dangerously high speeds estimated at 70 miles per hour. Suddenly, the boat hits the oncoming wake of another large vessel, and the passengers are violently tossed around the boat's deck. According to GrindTV , a sports video website associated with Yahoo Sports, all seven boaters were injured and five were hospitalized after the accident. "As viewers can see, none of the passengers was wearing a life jacket or any kind of protective gear, while clearly traveling at high speed," commented GrindTV. While some commenters on the video urged the importance of life jackets and restraints, such as seat belts, when riding in such a high-speed vehicle, others were taking more of the "tough love" approach, saying that the passengers of the boat participated in "reckless stupidity." "Driver's not wearing seat belt and operating at high speed. Negligence for the driver. I hope the police see this and charge him. Makes people think twice," commented one viewer on YouTube. "They all look like crash test dummies tumbling inside a washing machine," commented another viewer. The footage , filmed by LakeTV from the front of the boat, shows a Fountain powerboat — and its passengers — violently slamming from side to side after hitting the wake left by another boat. The group attempts to hold on to the boat for stability but ultimately get tossed around like rag dolls. The driver, Marvin Carter of Memphis, Tenn., was cited with careless and imprudent operation following the Aug. 24 incident. But when the video of the accident was uploaded to YouTube on Aug. 31, he received another citation. “After seeing the video, he was charged with a seating violation,” said Sgt. Jerry Callahan of the Missouri State Highway Patrol’s Water Division. Callahan said that Carter estimated he was traveling 70 mph when the accident occurred. Brett Tintera, a cameraman with LakeTV who was on the boat, disagreed with that estimate and said that Carter had floored the boat moments before the accident. “We were doing over 100,” said Tintera, who added in a phone interview today that he’s been boating for over 20 years and dealing with high performance craft for the last half dozen. “When you open the throttles up, you go way higher than 60-70 mph.” There is no speed limit on the Lake of the Ozarks during the day. The nighttime speed limit is 30 mph. However, the water patrol can still cite boaters for speeds that it believes are unsafe for the conditions. The boat was participating in the Poker Run, a charity event that is part of the Lake of the Ozarks Shootout, which bills itself as “the largest unsanctioned boat race in the Midwest.” Tintera said the Poker Run had a 70 mph speed limit. Carter of Memphis, Tenn., and four passengers, including Tintera, were taken to area hospitals. Two women on board — a mother and daughter from Memphis — declined treatment at the scene. Tintera, who is visible in the video wearing a blue shirt in the right rear portion of the boat, suffered a broken leg, broken wrist and ruptured disk in his back. None of the passengers was wearing a life jacket, though there is no requirement that they do so. “The lake shouldn’t get a bad rap, and the event shouldn’t get a bad rap,” Tintera said. Callahan said the accident could have been a lot worse. “We’re really lucky — falls overboard are the most common fatality accident nationwide,” he said. “We’re lucky all the passengers stayed in the boat.” Shawn Kober, co-owner of LakeTV, an independent television station that covers the Lake of the Ozarks region, said it was not unusual for the station to be filming action on the lake. “That’s just our niche - we film on the water,” Kober. Kober uploaded the footage to YouTube on Friday as part of a regular six-minute-long weekly news update. By the time he went to sleep that night, it had accumulated 4,000 views — already a respectable total for the station. When he woke up, it was at 100,000. By late this afternoon, the original had nearly two million views, and various other videos including the footage pushed that number significantly higher. One video with footage of the crash set to dub step music , for example, had more than 590,000 views. The video has been featured on Today, Good Morning America and the homepage of Yahoo! News. “This one was just the right angle for the wrong moment,” Kober said. It turns out that some of the people featured in the video are from Memphis. The video shows an outing on Lake of the Ozarks in Missouri and boating experts say the video is no laughing matter. The YouTube video shows the speedboat slam into a wake at an awkward angle. It sent the seven people onboard, three of whom are from Memphis, twisting and toppling about. Each person required medical attention. The boat's captain, Marvin Carter III, owns the Gus's Fried Chicken on Mendenhall Road. An acquaintance of Carter's said one of the women on that boat was his girlfriend. "They're very lucky to be alive, all of them. Couldn't tell you how lucky, how lucky," said Sandy Coles, Marine Supply. "Because a lot of times, those boats will roll all the way or they'll catch and flip everybody out." Coles said the boat is made for speed but it was going too fast, especially since nobody was wearing a life jacket. "And they're standing? Tell you what, go ahead and get on the back of your pickup truck, get on the interstate, and tell me how safe you feel. It's just… but that's, you know, boating," said Coles. Doctor Vanished in Mysterious Nighttime Boating Accident After Being Charged in $100M Fraud SchemeDr. Marvin Moy reportedly fell overboard a week before he was scheduled to appear in U.S. Federal Court A New York City doctor who was charged in a federal $100 million health fraud scheme is missing after he fell off a boat in an alleged collision during a midnight excursion off the coast of Long Island in mid-October, say authorities. Dr. Marvin Moy was one of more than a dozen doctors and others who were arrested and charged by federal authorities for allegedly stealing more than $100 million from insurance companies, according to a statement from the U.S. Attorney's Office for the Southern District of New York. On the night of Oct. 12, Moy took his boat for a ride in the Atlantic Ocean off the coast of Long Island with another passenger on board when an "incident" took place, according to a statement from the U.S. Coast Guard. "The incident was reported just after midnight on the morning of Oct. 13 of an alleged collision involving Mr. Moy and one other person with a large vessel," the statement said. The doctor went overboard "and the other person was recovered while Moy remained missing, the statement said. "We conducted boat and helicopter searches for over 30 hours covering 4,830 nautical miles, finding only the Emergency Position Indicating Radio Beacon that he was allegedly holding when he was last seen," the Coast Guard said in the statement. An EPIRB is a portable distress beacon that gives searchers an exact location during an emergency at sea. The boat, the Sure Shot, sank, the Coast Guard said in the statement. Rescuers saw evidence of a crash, including debris and an oil sheen on the water, the New York Post reports. The Coast Guard also interviewed people on other vessels in the area who didn't know that a crash had taken place, Fox News reports. Moy remains missing. "In regards to Moy's condition/whereabouts, The Coast Guard considers only facts and opinions within the Coast Guard's competence and makes no conclusion regarding death," the statement said. Although the active search has been suspended, Coast Guard units will continue to stand by for additional information that could assist in the investigation." The statement ended by saying, "The investigation into the cause of the sinking is ongoing." The passenger on the boat with Moy has not been publicly identified. Details of Alleged FraudMoy vanished less than a week before he was scheduled to appear in federal court for a hearing. In January, Moy was one of 13 defendants indicted and charged in an alleged $100 million health care fraud, money laundering and bribery scheme. "The thirteen defendants charged in today's indictments are alleged to have collectively perpetrated one of the largest no-fault insurance frauds in history, U.S. Attorney Damian Williams said in the statement from the U.S. Attorney's Office. "In carrying out their massive scheme, among other methods, they allegedly bribed 911 operators, hospital employees, and others for confidential motor vehicle accident victim information," the statement said. "With this information, they then endangered victims by subjecting them to unnecessary and often painful medical procedures, in order to fraudulently overbill insurance companies," the statement added. It continued: "Schemes exploiting no-fault insurance laws – which ironically exist to make insurance more affordable – also result in higher costs, and unfairly burden all consumers in the auto insurance market." Moy pleaded not guilty to the charges. A friend of Moy's hopes he is somehow alive. "I would obviously like for my friend to be found," the friend told the New York Post. "There's still a chance he's shipwrecked on some small rock," the friend said. If convicted, Moy faces up to 30 years in federal prison. Moy's attorney was unable to be reached for comment. A cameraman captured the frightening ordeal on the Lake of the Ozarks, where seven people were furiously tossed — but managed to survive — when their high-speed vessel was battered by the waves. Brett Tintera, of the local independent station Lake TV, was riding in the boat and uploaded the footage to YouTube on Sept. 1. It quickly garnered more than 100,000 views. “We were doing over 100 [mph],” Tintera told the Springfield News-Leader on Wednesday . He reportedly suffered a broken leg and wrist and other cuts. All but two people on the boat were taken to the hospital. The boat’s driver, Marvin Carter, of Memphis, Tenn., told authorities he was going about 70 mph. “After seeing the video, he was charged with a seating violation,” Sgt. Jerry Callahan, of the Missouri State Highway Patrol’s Water Division, told the News-Leader. According to the newspaper, there is no speed limit on the lake during the day, although patrols can cite drivers who they believe are steering recklessly. “Unfortunately, it’s the stories of the injury accidents when … people really start to pay attention,” Callahan told Fox affiliate KTVI. “And we are lucky in this instance, I think.” Tintera said they were participating in a Poker Run, a charity event in which boaters race to different checkpoints to draw a playing card — ultimately competing for the best hand. While no one was wearing a life jacket, which isn’t a requirement, the bruised riders were lucky to avert a greater tragedy, officials said. “I hope people are looking and saying, ‘Wow, that could have been really bad,'” Callahan told KTVI.
